Guidance On Calculating Workers’ Comp Benefits
The primary goal of workers’ comp is to ensure that injured workers get timely medical treatment and uncontested financial assistance. In New Hampshire, workers' compensation plays a crucial role in sustaining a positive working relationship between companies and their employees. It helps prevent companies from being overwhelmed by legal claims and ensures workers are protected in case of an accident. This organized approach to managing workplace injuries is beneficial for both employees and employers, providing a streamlined process for these situations.
New Hampshire Workers’ Comp Benefit Calculations
- If the injury occurred on or after February 8, 1994, your workers’ comp benefits will be based on 60% of your average weekly wage. Your average weekly wage may be calculated by adding your gross earnings from the 26 - 52 weeks before the injury and dividing by the number of weeks. If you have not worked for at least 26 weeks, then your starting wage may be used to calculate your benefits.
- If your injury happened before February 8, 1994, then your benefits are 66 ⅔% of your average weekly wage.
If your average weekly wage is the same as the minimum compensation rate or less, then you will be compensated the full amount of your average weekly wage, but it will not be more than 90% of your after-tax earnings.
No matter when your work injury occurred, the weekly rate of your workers’ compensation cannot be more than 100% of your after-tax earnings.
If you have more than one employer are they are subject to the NH workers’ comp statute, then you may be eligible to receive indemnity benefits from all of your employers. Do Pre-Existing Conditions Affect The Workers’ Comp Benefit Amount?
Pre-existing conditions can significantly affect the benefits that workers receive from workers' compensation. In New Hampshire, employees are still entitled to benefits for work-related injuries even if pre-existing conditions contributed to the injury. However, these conditions can complicate the claims process, often requiring additional medical evaluations to determine the extent of the work-related injury.
